Waiver

CLARK POWER SKATING PARTICIPANT WAIVER OF CLAIM AND ASSUMPTION OF RISK

Upon registration, in consideration of permission granted to me now or in the future by Clark Power Skating (the “Organizers”) to participate in the activities associated with Clark Power Skating, (the “Program”), I (the “Participant”) agree and acknowledge that:

I will abide by all rules imposed by the Organizers upon the participants in the Program.

I am aware of the risks and hazards inherent in the nature of power skating, and I have full knowledge of the nature and extent of these risks and hazards. I understand that in participating in the Program that I may suffer personal injury or death.

Notwithstanding that I am fully aware of such risks and hazards, I freely and voluntarily assume the risks involved in participating in the Program and in doing so, I understand that I will be solely responsible for any loss, injury or damage I may sustain, and that my participation in the Program shall be entirely at my own risk.

Notwithstanding that I am fully aware of such risks and hazards, I understand that I may be held personally responsible for any loss, injury or damage I may cause to other participants in the Program, and that in participating in the Program, I accept this risk of liability.

I also consent to the collection and use of the registrants images by posting on the web site of Clark Power Skating. I understand that personal information can be viewed by anyone who accesses Clark Power Skating’s web site or publications and that my consent can be withdrawn at any time.

I hereby waive any and all claims I may now and in the future have against, and release from all liability and indemnify and save harmless the Organizers for any claim, including any claim for medical services arising from my participating in the Program, and hereby agree not to sue the Organizers and its employees, insurers, agents and representatives (collectively “its staff”) for any personal injury, death, property damage or loss sustained by me as a result of my participating in the Program due to any cause whatsoever, including, without limitation, negligence on the part of the Organizers or its staff.

I acknowledge that I have read this entire Agreement prior to accepting it and have had sufficient opportunity to obtain any desired information and independent legal advice prior to signing it.

I am aware of the nature and effect of this Waiver of Claim and Assumption of Risk. My voluntary acceptance of this Waiver of Claim and Assumption of Risk is binding upon myself, my heirs, my executors, administrators, personal representatives, insurers and assigns.

In entering into this Agreement I am not relying on any oral, written or visual representations or statements made by the Organizers to induce me to participate in the Program.

I am executing this Waiver of Claim and Assumption of Risk freely and voluntarily without any compulsion on behalf of the Organizers.
